Driving a girl home from a date, hit a patch of ice, slid thru a red light & got smacked by a '93 Pathfinder...

His vehicle is totaled... Still waiting to find out how much mine's gonna be. Oh, and to add insult to injury I just found out today that my insurance company went belly-up (ch.13 liquidation)... This is all gonna be out of pocket for me

Might be hard to wheel it anywhere if he can't get gas in it ! That's gotta suck. Sorry dude.

The state doesn't have any provisions for insurance companies that go out of business? They are a regulated industry, have you tried contacting any sort of consumer advocate / agency?

Good luck -

Insurance? Sounds like Uncle Tony got whacked during dinner at Luigis.

I would be surprised if belly up didn't mean "got sold to someone else." Where have your checks been going?

Yeah...that kinda hurts. TSLs were never meant for ice.

If the frame's still straight and the cab can be "liveably" repaired, I'd be inclined to throw a flatbed on and keep driviing it.

Definitely still wheelable... No frame damage that I can see; Just a fair amount to the body.

Waiting to get a quote on the repairs now... We'll see how ugly it is.

I think I'm gonna need a bigger hammer...

The insurance company was called Legion Insurance (also dba Villanova Insurance) out of Pennsylvania. Supposedly they sent notification back in July, but I never saw it. Turns out, the folks cashing my checks the last 2 months were the state liquidators... Apparently they simply see all incoming checks as Accounts Receivables. I can file a claim to get that money back without too much fuss, but as for being able to make a claim on the accident it's a 'get in line' scenario. I talked to the Guaranty Association for Oregon & didn't like their answer, so I talked to a lawyer friend of mine; Same answer. They're all blood-sucking leaches. (no offense to anyone on here who's in the insurance industry )

Heck, if that was the case I'd be talking like Michael Jackson now

I dislocated my shoulder, but it wasn't too bad... The other guy & my date were just fine.

I think you should get to States Attorney Office.
Here are my reasons why.

1. You paid insurance premium, you sent in the check with your policy # on it. Did they think you paid for an insurance you do not have anymore because you are rich?

2. When they supposedly send you the notification, did they send it by registered mail? Have them prove that they sent it to you, and you received the notification.

3.Is your Truck still financed? If yes, was your finance company notified that you did not have insurance anymore? By law they have to be notified.

4. When insurance is manditory in your state, was your DMV notified that you did not have insurance anymore?

I really would like that you go and fight this and go sue the insurance company and their liquidators.
Also find out how many other people have the same problem or are going to have the same problem. Put in Ad in the Paper and go on the the Nightly News or National Nightly News.

Here is one of the reasons why I would like you to fight this:
We have a lot of deployed Soldiers. They are paying their insurance premiums either by mail or by allotment or bankdraft. When they come back, they think they have insurance, get in a wreck, and find out that they do not have insurance. They can get in trouble financially, with the police and so on, but also could get UCMJ actions from the military, because they did not have insurance. In the military you have to have insurance.

Please fight this. Fight fire with fire. Sue, go public do what ever it takes, so other people do not have to go thru what you are going thru.

Good luck, and keep us posted.
