If she is a registered Ebayer, she should go to the auction and "ask seller a question". Dont the questions show up towards the bottom of the auction?? That way she can slam the seller by letting all know "thats my 4Runner, but it doesnt have any of your crap installed....does this mean I get your products for free in lieu of payment for using my pictures to scam others"?? <img src="/forums/images/graemlins/smile.gif" alt="" />

If the pictures aren't copywritten(must be stated as such on each photo), he/she isn't doing anything illegal. He may have needed a picture of a 4-Runner similar to the one he is selling, went and found one. If you share your photo's on the internet and you don't copywrite them, anyone is free to use them as they wish. The internet is a public domain, and in a public place no permission is needed to take someones picture or that of their property, and do with it as one pleases. As mentioned, the best thing to do when you find someone using your pics, is to change the link to something else, or spend the mobey to copywrite your pictures. It is nice to see that Ebay took them off after the complaints.

Actually pictures, videos and other media do not need to be watermarked to be copyrighted.

This came from a friend who had his truck removed many times from various webpages: "copyright law automtically applies upon creation of an image, picture, painting, writing, etc. you do not need to file a copyright for it to apply.

as long as you can prove it is your creation, then you have copyright to it. no need to watermark it"

The problem here is that he is using it for monetary gain without permission. If it was for a reason considered to be "Fair Use" such as news reporting, teaching, etc. it would be ok.

Does eBay actually upload the pictures or do you link to them like here at 4x4Wire? My thought was if he was just linking to her pictures, she could change the picture to something like "This Sucks!" and the new photo would show up in his auction.
