I talked to the machinist and he said his boss would allow for them to make me another driveshaft at no charge but they wouldn't pay for my gas tank.

I asked to speak with his manager and he said he'd give him the message to call me. I asked when I would hear from his boss and he said he wasn't sure. I plan on calling at the end of the day tomorrow.

I feel I'm entitled to the tow charge, the driveshaft, and any damage their malfunctioning part may have caused.

Am I wrong?

He tried to say to me that it was my fault because I had them take out the carrier bearing and make me a 1-piece and that was why it broke. It wouldn't have anything to do with the fact that he didn't balance it. <img src="/forums/images/graemlins/rolleyes.gif" alt="" />

Well... if it wasn't safe then why would you do it?

After I talk to his boss/the owner and he doesn't oblige (which he won't) I'm going to have my lawyer friend speak with them.

I definetly think that you deserve complete compensation for the damage done. He took on the task and delivered the product in poor form.

Had a shop do an estimate for me yesterday afternoon.. the skid plate and the tank both took on a pretty good dent, but the gas tank isn't actually leaking.
Garage said it's the sending unit.

Sending unit + gasket, bolts, etc = $149
2-3 Hours labor @ 50/hour = $150
Driveshaft = *shrug* whatever
Ujoints = I don't remember.... like 50 bucks


I think I'd be willing to cut them some slack with the tank as long as the tank doesn't take on a HUGE cut in capacity. I'm sure it's not much at all.

Should I have them build me another 1-piece or should I have them build me a 2-piece like stock?

I'm pretty nervous about the 1piece now; I'm fairly certain they wouldn't be willing to do it a 3rd time for free if something screws up again. <img src="/forums/images/graemlins/scared.gif" alt="" />

Just got off the phone with them again, talked to the owner this time.

He said they will stand behind the driveshaft but will not pay for any of the damages. I told him basically that didn't cut it for me so he said they wouldn't cash my check for the work they did but they're not paying for anything more because the factory doesn't use a 1-piece they use a 2-piece.

I told him that when his employee handed me a driveshaft that was not balanced they assumed the responsibility of the fact that there may be a problem with the product I was given.
He responded saying that his shop foreman didn't have enough time to balance it.
I said I shouldn't have been given an incomplete product, then.

This is a mess. *calling lawyer now

also: pardon my incessant ranting this thread is also a way for me to document what's going on. I just get the added bonus of you all helping me out <img src="/forums/images/graemlins/smile.gif" alt="" />

Whatever ya do- just watch what you saw.

Friend back home has a short fuse, and after the tractor mechanic boogered up the hydraulics on his machine, he said 'If you don't fix this within the next day, I'll burn this place to the damn ground'...this being said in front of customers and other employees.

Well...two days later, shop still has the tractor, and it burns down the third night, with the tractor inside. Police questioned my buddy with eyewitness testimony, etc.

Turns out the owner of the shop was messin' around with another guy's wife, and the guy burnt the shop down after he found out who it was. At least my buddy got a new tractor out of the deal.

That's a simple statement that has stuck in my head for some 40 odd years.

From what you post I would say they should have just fixed it with an apology. There is no shame in making a mistake, everyone does from time to time (Except for me..*I get to blame stuff like that on my crew..*LOL**)

I have def. been holding my tongue and making sure I'm calm before I call, every time. I have a short fuse sometimes too and I realize it. I also know that it helps absolutely nothing to be angry at them. In the same respect: if my customers come to me b*tchin and carrying on then I don't want to help them either. ;o]

I totally had faith in their work, and I've seen the stuff they've produced before. I'm not judging them really on this one mistake but I just want them to (like you said) admit the mistake and take responsibility for it.

I can't guarantee that I'd go back there for more work again but I wouldn't say that they produce shotty parts just because what's happened. "They're only human.. people make mistakes, etc" smile

I had to go through Lemon Law with Ford back in 2001. That wasn't fun. Good luck.

I did see the customer one time after that, he stopped in to ask me some questions about his truck.

Guess he thought I was an old coot, too..which I am but I don't have any booze around, and the guns are at home.

Best to always approach a problem with a calm and reasonable voice and be willing to negotiate, it works best....*EB
