Rusty, thanks for sharing.
I'm sure if it didn't happen in a Southern state (I'm assuming it did) then the police would have had a hard time accepting getting beat down as 'justifiable deadly force'...or the whole concealed and unpermitted aspect of it too.
I'm assuming due to your inabilty to flea or defend yourself, they considered such force warranted, or did they ever offer an explanation?

You pretty much hit the nail on the head. I live in NC where carrying a handgun openly doesn't require a permit, only to purchase one. The fact that it was concealed at the time was debatable because I was on private property and the gun was kept in plain view while I was driving. This "could" be taken one way or another were a lawyer to argue it in court, but in my eyes and those of the detaining officer and detectives I was within the scope of the law for these actions.
And it's very true that if I were not in a southern- or at the very least a conservative state- the outcome of my innocence may have been questioned more thoroughly. Don't get me wrong- I got the 3rd degree while I was in the hospital getting tests done, but it was fairly evident that my injuries and as you stated- the ability to flee or otherwise avoid the situation did come into question. I alrady suffer from severe back problems as well as recurrent blood clots (DVTs) and over the years I've come to the point where I have to use a cane about 50% of the time at my ripe 'ole age of 26.
As far as their explanation to me once the handcuffs were taken off were the somewhat comforting words of "You've got nothing to worry about. You did the right thing." Which doesn't mean that the other party couldn't press charges, but I did go home knowing that the 'state' wasn't going to. In fact, the officer told me that I could initiate a warrant myself and press charges and to get a restraining order. The stupid thing is- I want/ed this to go away so I didn't want to pre-emptively press charges, but I thought a restraining order wouldn't be a bad idea not knowing the extent of his wound- but knowing that he did have a screw or two loose. Well, apparently the police and the magistrate don't communicate very well because when I went there (to the magistrate's office) they told me that I had to be pressing charges on someone in order to get a restraining order. Clearly the magistrate could see that one whole side of my head was almost twice the size of the other!
But anyways, I hope I answered your questions; if you have any more or want to talk about it farther that's fine. A month ago it would've been a different story...even now I must go and take a valium and/or a xanax...

Yeah, it's nice to live in a state where everyone's an honorary NRA member :lol:
I can't say for sure, but I can only imagine the excruciating pain a .357mag shot point-blank somewhere between the calf and ankle...probably worse than death...."0.357 going in, 3.57 coming out" I'd say that's a safe guess. From what little I've heard, he had to have at least 2 surgeries and a skin grafting.
The worst of it all is I lost every single person who I thought was a friend. When it boiled down to it, everybody felt sorry for him and not the true victim...I don't want pity, but it was one helluva way to find out who my true friends were/are.

Im dreading my summer in California...cant find a 10rd. mag for my 45...the laws are rediculous...goes back to the "only police need high capacity magazines to protect themselves not defense-less citizens..."
I have a CCW for Idaho, cant protect myself in left wing states i guess.

i read somewhere that doctors kill more people than guns.
Rusty, all I have to say is if I was in your shoes friend or not I don't think I would have the strenght to shoot him just in the leg. They would be picking up brain matter for the next week.
Being from virginia i can say gun laws are alot more relaxed than up north.Those of you that think cali is bad forget it New Jersey is the absolute worse state to get any type of gun,you have to have a buyers license for all of them. and you can forget about assult rifles unless it is for collection only(at least thats the way i understand it) There is a woman that runs the state wildlife dept. so you know what crap we deal with.at one time she was trying to make it where a .45 cal black powder was the largest black powder you could use.here are some of the gun laws.
You have to have a license to buy all guns you may only use shotguns, small bore rifles for small game like a .22 which you need another license for,a black powder rifle or a bow to hunt. in order to buy a handgun you need to automatically get a conceiled weopons lic. All guns you need to take a class on gun safety(heck i did that in middle school, part of health/pe class) I think but not sure that you must have a license to own a gun in Nj.
It is like this though the laws are so confusing Police officers are not even sure. when i moved up here i left my rifle at my parents. before i went down at christmas i went to the police station and asked them. the officer said as long as you have the ammo seperate from the rifle, you cant reach either one,it was bought legelly,and your not a felon you don't need a liceance and can bring it up here.so i did,Now i am being told by a different officer that i need a license,but another says i don't .
as for gun control the Govt. cant even keep 1 cop from unloading a 15 round clip on a defenseless citizen much les more than one. Yet they want to take our rights away, heck i need my gun to protect me from cops lol
