Absolutely! My wife was in an accident last year that totaled our Altima. She visited the chiropractor for MONTHS until she felt better...and then received a pain and suffering settlement. Even if they declare it a total loss, you will have the right to buy it back. Keep in mind, a totaled car will now have a salvage title. This really isn't an issue with something you intend to keep forever, so don't worry about that aspect. If I remember correctly, we could have bought it back for around $900 and it probably only needed a couple thousand to repair it as the airbags did not deploy. It was a 2000 Altima SE in excellent condition with only 50k on it. Anyway, I suspect your 'buy back' amount will likely be considerably less. When they decided it was a total loss, I argued about every single issue until they offered close to what I thought it was worth (diminished value, new tires, condition, mileage, etc.). Don't give up until you are satisfied, or until they pull the rental car, which may happen soon since they declared it totaled. Remember, the vehicle settlement is separate from the medical settlement. You can settle the vehicle and continue to seek medical treatment...which you should do as long as you need to.
I can understand how pissed you are Javy. I dealt with a string of incompetent people from the 'at fault' insurance company and actually lost my cool a couple times, something I NEVER do. Try to avoid that if you can, people will not work with you if you become belligerent.
