How much is the vehicle worth? How much can you buy it back for? If you get a check and buy it back, might come out ahead, maybe?

You must speak Southern to this man, sort of like this: "Now listen up Bubba, you sure as Hell ain't totaling my ride, know what I mean?"

If that insurance claims guy can't tell a unibody from a body on frame design he should be fired and given a job filling toilet paper, hand towels, and tampon machines in rest stations along Georgia interstates.

You do not have to accept his offer, by law they are required to make you a reasonable offer. That vehicle is a classic, and should be repaired. Look up the state insurance commisioner, I think he is John Oxendine, and report that jerk first thing in the morning.

I hope you get to feeling better, but God knows that could take months, maybe even years.

I fail to see what sounds childish<img src="/forums/images/graemlins/baby.gif" alt="" /> about that! Doesn't everyone here feel that way about their Monteros? It took me a long time to find one with lower miles and no rust (especially in Pennsylvania) and there is no way I would give it up without a fight!

Since the insurance guy seems to be taking orders from his computer, I have a few suggestion for what his computer could tell him to do next <img src="/forums/images/graemlins/evil.gif" alt="" />

Absolutely! My wife was in an accident last year that totaled our Altima. She visited the chiropractor for MONTHS until she felt better...and then received a pain and suffering settlement. Even if they declare it a total loss, you will have the right to buy it back. Keep in mind, a totaled car will now have a salvage title. This really isn't an issue with something you intend to keep forever, so don't worry about that aspect. If I remember correctly, we could have bought it back for around $900 and it probably only needed a couple thousand to repair it as the airbags did not deploy. It was a 2000 Altima SE in excellent condition with only 50k on it. Anyway, I suspect your 'buy back' amount will likely be considerably less. When they decided it was a total loss, I argued about every single issue until they offered close to what I thought it was worth (diminished value, new tires, condition, mileage, etc.). Don't give up until you are satisfied, or until they pull the rental car, which may happen soon since they declared it totaled. Remember, the vehicle settlement is separate from the medical settlement. You can settle the vehicle and continue to seek medical treatment...which you should do as long as you need to.

I can understand how pissed you are Javy. I dealt with a string of incompetent people from the 'at fault' insurance company and actually lost my cool a couple times, something I NEVER do. Try to avoid that if you can, people will not work with you if you become belligerent.

Javypro, I posted about your predicament on a varmint hunting board I frequent, as there are a few insurance agents and investigators on the board. Here are their various responses, hope some of it helps you.

Aches and pains. imagined or real carry a lot of weight with an insurance adjuster. When you consider that your friend is the injured party in this accident he doesn't have to roll over and play dead. It would be in his favor to get his own insurance company involved.

a car with that mileage is clearly at the end of its live. there are issues wit hmetal fatigue to key parts that may be latent. check what someone would pay at an auction. no dealer would tocuh it. it is a fact of life.

not knowing anything other than the vehicle would you buy anything wit hthat many miles.

he might be able to cash out the damage and repair as best he can, most states will limit the loss to the ACV of the vehicle when it cimes to third poarty claims. There might be some added for the newer parts but not much.

depending on the tort laws of the state he may or may not have a claim for personal injurty. if it is a so called no fault state there is a threshold to meet before you can collect.

I just re read my post. I didn;t mean to sound so negative. The issue with older vehicles has long been a problem. Most major companies will make a reasonable effort to try and resolve th issue. Here in PA if it is declared a total and you want to keep the vehicle you have to surrender the title and it will be reissued as a salvage or reconstructed vehicle ( once it is inspected by a Insp station and a Pa state trooper) . That keeps clean titles out of the flow for stolen vehicles.

I am not sure but if he doen't want to total it out then he doesn't have to. I would have him see a laywer and get his own INS company involved.


He can call the Ins Co and settle then do an "owner retain"..basically if the trucks worth a 1000 bucks, say salvage value(what the Ins co gets when they get ris of it) is 100 dollars. He can keep the truck and get a check for 900.00 Make sense? Should not be a problem. Every Inso co I know also has interpreters avail of thats a problem at all. The Ins co does NOT have to fix the truck , no way to force them to spend 3000 on a 1000 dollar truck or whatever the value is. If he has receipts and can prove all the improvements etc he can substantially raise the amount he gets when it is totaled. Depending on who HE has for Ins he might be better off going thru his own carrier for better service.

As of Thursday of last week, Rolando was in Puerto Rico on vacation. The insurance company told him the car had been towed away and sold for scrap. That wasn't correct, as I went to Willard Wrecker's in Buford and saw his Montero parked against the fence. I phoned him and gave him the info. That is all I know for now.

I may be completely incorrect, but I thought the insurance company is obligated to offer the owner an opportunity to buy back the vehicle. Regardless, that's infuriating. I hope this works out, let us know how to help...

Well guys I am back and this issue is still not over. The car is at the body shop and they will provide me with an estimate of the damage to then give it to ALLSTATE. The guy at the body shop told me that it oly needs the fender, the apron, bumper + the plastics(signal light and headlight surrounding) I got the fender online for $132.85 but I cannot find the apron. I also got the bumper at the local yard but still i don't know the price oh and also the leafspring. if any of you have some parts please let me know.
Dealing with these people is a pain in the <img src="/forums/images/graemlins/butwiggle.gif" alt="" />
