What has an independant body shop quoted you for the repairs?, if the damage is only the to the bed and bumper it shouldn't be that much to fix it. If the frame is staight and the vehicle is safe you don't have to total it, get a couple of quotes from some shops and see what they think it will cost to repair the truck. I am not sure about WA law, but here in CA you don't have to let the insurance co. total the vehicle to get them to pay for the damages. If the vehicle is still safe to drive you can get up to the blue book value from the insurance co. w/o totaling the vehicle. My Dad just got a check for $2300 for the damages caused to his '86 2wd Toyota farm truck. At the time he was rear-ended and shoved into the truck in front of him the value of the truck would have been about $1000. You should be able to get the $2400 from the insurance co and retain the truck, after all it was their client that caused you the loss of property. Check the auto insurance regulations for WA, and see what your rights are, or check and see if you have any free legal clinics in your area, communities close to a university or law school, usually have one run by students.
