Check with the HOA and/or surveyors/state. Where I grew up, if you're paying for the whole thing, the setback into your property is 2". Here, there is no provision for that.

Paint the neighbor's side of the fence pink or orange.

Naw, that's a liability. I even post signs for my apiary. Those colors will #1 honk him off; #2 might prompt him to drop some of his OWN coin to repaint that side of the fence. Think Huck Finn here.

Just tell him to make every third picket about a foot taller than the rest. Nothing says "howdy neighbor" like fifteen yards of the one-finger salute!

I know. But it's fun to think about.

Perhaps he can rent that side of the fence dirt-cheap for advertizing space.

A big "F" the "A"! Comes from my way on the subject. I will never forget the BS I went through with my condo s. They gave themselves right to misuse money, make things to their benefit, and a way to throw people to the dogs.
I wish I could go back and teach them a lesson some how.
In my mind, people should use good reasoning when dealing with neighbors. Not a bunch of hidden agenda's or small print, you can't do this and we need revenues, here's your fine. Now pay up and while your at it, fix that to our standards, type of BS!
Been there and have gone through it. 90% of us work for a living and are not home all day. While those blue hairs struggle to walk around and try to sneak-a-peek at what your doing jealous of what it is or whatever. Then you get a letter in the mail with a day or two to respond and fix or a fee will be assest. that.

Hi Guys,

Thanks for all the input! We're supposed to start tomorrow evening. I'm not sure what style the fence is called, but the other fences in the area are well the same...on both sides. It isn't the good neighbor type with every other board on your side, or all boards on the outside. The boards are sandwiched b/w 2x4's and centered on the 10x10 posts...so everybody's looks the same.

I like Capn's idea, but i'm reminded of an old Ren and Stimpy episode...Don't wizz on the electric fence! Although kewlynx's idea doesn't sound half bad by earning money on your fence. My friend and this guy moved in around the same time as the entire are is a new development so his year time limit is fast approaching. Kewlynx you read my mind! I told my friend he should paint the neighbors side pink or orange and if he painted over it call that vandalism as its my friends fence and he 'liked' the pink on the otherside . I will ask him to notify his HOA and see what regs he has to follow or if anything can be done.

I hear you guys on the whole HOA thing. When the wife and I were looking we only found one place that didn't have requirements per se. The only stipulation was that neighboring houses couldn't be the same color. We didn't end up buying there as this was during the housing boom up here and we would have taken it up the by contractors to build there as they were booked solid by the community types...plus all the houses in the neighborhood were in the 3500+ sq. ft range walkout basements and I didn't think we'd be getting any sunlight at our place

So back on topic, as far as I know said neighbors keep to themselves and I don't think there's anything other than this incident to complain about. I've never seen them the times I've been over. As far as the HOA requirements: Fence has to be so tall (same as the others), same colors, 10x10 posts, grass, one tree (2.5" diameter measured 6" from base) and one shrub. My buddy had to (no choice) put down $4000 I think it was subject refund once said requirements were completed...and to top it all off it had to be done within one year of receiving rough grade (tough luck to him since its winter about 6 months of the year).

I think I might start a landscape rental company. Thats right, a landscape RENTAL company. RENT out sod, trees, shrubs, etc. until people get their money back and tear it all out and off to the next lot!

I see this happening over the long weekend:
and hopefully no one on the new grass!
