Personally... I don't need more government, more laws, more rules.......

It'd just be quite a bit more simple to live away from all the crap, and enjoy your privacy, and let your neighbors have theirs. [Linked Image] I don't care what my neighbors do short of cooking meth, or shooting in my direction. Even if someone were to buy adjacent property to me, and move 13 trailers in there it'd not effect me 1 bit.

I guess I'm just a live, and let live kinda guy though.

That guy said there was no HOA until 1 year after he bought the house.

Putting boots on cars for one tire touching a white line is stupid. Putting 2 boots on a car because he does not have a hang tag displayed when they know he lives there and has parked there for the past few months is just stupid. Also the booting people did not follow the rules as their contract stated. In this case, I think the boots were out of line. I agree with keeping crappy non running cars out of the way, but they just went stupid with it.


I just want to tell you both good luck, and we're all counting on you.

Nothing wrong with that, Curtis - I've done that, too - and liked it.

The problems start when folks live very close together and rub each other the wrong way. Some folks still have respect for themselves and their neighbors, but some don't.

A couple of years ago, my neighbor - who was the founder of the largest legal firm in the state - got himself a new trophy wife. The problem became drugs - drugs for the kids and for the parents - kind of a his 'n' hers thing with the neighborhood turned into a "go to" place for wild times. It got so bad that one day when my wife was in the front yard, all you could hear from the boys throwing a football in the cul-de-sac was the 'F' bomb...... "F" this "F'ing" that. I'm fairly easy going, but that crossed the line and I found myself confronting about a dozen 18 year olds who then wanted to get smart and fight. Of course, they all backed down and went away, but the problem remained for the neighborhood until the wife spent all the husband's money, they divorced, the kids went away, the house and cars were foreclosed on, the fellow went to the hospital with cancer, lost everything.... including the cars and house and moved away - leaving the neighborhood once again fairly peaceful.

I don't think any sane person would want to live near that.

I lost a couple hours of my life reading through that last night, but it was entertaining. The guy is sticking it to them and hasn't done anything illegal.

From a parking enforcement standpoint, the success of the boot is predicated on the notion that you will pay to have it removed because you really need to use your vehicle and can't move it otherwise. However, if the guy doesn't need his car badly enough, and is capable of moving it, then all the company has done is come onto private property where he was legally parked and donated their property to him by attaching it to something he owns. He hasn't damaged it, and he hasn't stolen it as the company is free to take it back at any time. If it was in my garage, I would notify the company that I have their property, by recorded phone message, email, and certified mail, and start charging a storage fee after 48 hours. Once sufficient time has passed that it can be considered abandoned under local laws, there's no reason he couldn't attempt to recover part of his storage fees by selling it for scrap. <img src="/forums/images/graemlins/lol.gif" alt="" />

That is just plain old wrong allowing private contractors to patrol public or private streets. I think the HOA might have already been there as is usually the case, but the parking enforcement was something that was added on later. HOAs are essentially private governments who enforce private contracts between the owner and HOA.

A major problem with HOAs is that they make up their rules, then they enforce those rules using YOUR money. In other words, the HOA leadership loses nothing and they are not personally liable for their decisions. They take your dues then enforce those rules as they see fit, using your dues against you. You as a home owner then have to fight them in civil court using your own money. It really pretty one sided, which is why itÆs usually not wise to get into one of these organizations.

Not all HOAs are evil, but thereÆs too much room for potential abuse. People can try to throw the leadership out, but these are usually the ultimate good æol boys clubs, because voter participation is not always very high. Most owners just want to pay their dues and as long as they arenÆt messed with, they donÆt care. ItÆs the guys that get targeted unfairly that get screwed.

For people like us with modified rigs, who also like to work on our rigs, we are usually the bane of HOAs which can be a big problem.

If someone has to live in a neighborhood that is so damn picky as to have to decide what color your house is, whether or not you can have a car in your driveway, a flagpole in the yard, much less having to get approval for every single repair or improvement or addition you want to do your house, then they are far stingier than I and deserve whatever they get.

I feel for this guy, but he did buy and move in to an HOA neighborhood and now he understand why they suck. I hope he wins and IÆm rooting for him, but this is still a lesson for everyone else.

Not all HOAs suck like this. Some are decent, but even the decent ones can morph into evil nazi organizations later on if new people take over. So thereÆs never a guarantee.

Personally, I think neighborhood associations that meet and work directly with government as a political group to help their nieghborhoodÆs interests such as government road maintainence and police patrols and fire services are far more valuable than targeting invidual home owners for how they park their cars or trim their bushes.
