I've owned my home for 18 years and its paid for! I'm one of the older posters here and yes I've earned my privelige of semi privacy where I live, although I must still endure dogs barking and kids screaming all summer. Theres no FN way that I would ever subject myself to urbanization! The main point of the parking issue was that the parking company was overstepping their authority by a significant amount. The Audi owner did not have an issue with the HOA's authority or rules. The guy had been parking legally for long enough that APS had to have known the vehicle was owned by a resident. One infraction & his vehicle was booted, rather than the 3-step process that APS's contract with the HOA required.
I live in a community with a HOA & have received warnings for vehicles parked on the street for too long (relatives from out of town visiting over Christmas), messy yard (damn Mesquite tree seed pods), and oil stains in my driveway (cleaned as best as possible). I have felt picked on, as there are other homes that have had far more blatant violations than mine were, but I also accept that the HOA is overall just trying to enforce the rules that I knew of & accepted when I purchased my home.
All I have to do is drive through a comparable subdivision with no HOA to see the homes that don't get taken care of, and compare the resale value of homes there vs. mine to see the value of the HOA & find the patience to deal with them.
FYI - My property isn't large enough to park any vehicles on except in the garage or driveway, and I've never been hassled about working on my vehicles in my driveway or garage with the door open - which I do frequently & is not supposed to be allowed.

The main point of the parking issue was that the parking company was overstepping their authority by a significant amount. I haven't read the whole thread, but with that suggestion, I did read the first page and found this in the first post: Well, it's just a long day @ work, your mind is busy, you park and don't put your pass on your rear view. Oooops - looks like an admission right off the bat.... HINT: don't say that in court. I've parked in the same spot for 3 months, always displayed, they know the car, a extensively modified Audi parked in the same spot for 3 months with a displayed pass. Nope - that won't do for an excuse.... the parking passes are for display while parking - not for wallpaper. It's a no brainier I have a pass. The "no brainer" is the guy who has a parking pass - therefore knows he needs one for display - yet doesn't display it because the poor fellow is tired from working all day...... wonder what the other residents do to pay the bills? Now, why wouldn't I always keep the pass hanging from my rearveiw? Being in the top 10 auto theft capitals in the country, I'm not comfortable DISPLAYING where I live when the community is displayed in the largest characters on the pass. Understandable, but the choice to not display at times "off-property" must be replaced by "display" when on property or penalties ensue. The guy had been parking legally for long enough that APS had to have known the vehicle was owned by a resident. You can't expect others to cover for you when you screw up. What if the person issuing the ticket had just started working for the patrol company that day? One infraction & his vehicle was booted, rather than the 3-step process that APS's contract with the HOA required. All it probably takes is one infraction - why should anyone get warnings? If there's a 3-step procedure, feel free to post it - I'm sure not going to read all of that nonsense...... BUT..... the fellow is certainly industrious and has a great sense of humor. I'd love to be the prosecuting attorney in this one if that's the only rationale. From what I've read, if I was the judge, I'd congratulate him on his originality and sense of humor.... and then tell him to pay the $140 or go to jail. Frank

I did not read the whole thing. But from what I understand, they are supposed to give someone a warning first. Then some kind of citation ticket like second warning thin. Then if it still was not taken care of, they would get the boot.
And like said above, the guy said he had the parking pass on his dash board, but not hanging from his mirror.
That thread has since been closed and I did not look for anything else. So what ever happened?
Oh yeah, I forgot. The contract also said they were to disable the vehicle by hooting, not booting.

It's pretty hard to remove a hoot without damaging the vehicle

The pass was in the windshield according to a later post and a picture to go with it. It just wasn't hung from the mirror. So, don't you wonder why THAT wasn't also stated in the first post? If he was concerned about advertising where he lived when not in the parking lot, it wouldn't matter whether it was on the dash or hanging from the mirror. Also, wouldn't you wonder about when the picture was taken? Then they should have apologized and reversed the whole thing. It wouldn't have been an issue at that point. If it was the HOA doing the citing, I agree.... but once they contract with an outside firm, there is a bill to pay for services rendered - which could be changed depending on the relationship with the contractor and how agreeable they wanted to be. I doubt if many booting companies are very agreeable and once the HOA signs the deal with the Devil, there's Hell to pay. The contract also said they were to disable the vehicle by hooting, not booting. Now that right there would get him off in my courtroom. If I was the judge, I would tell the contractor that if they couldn't read what THEY signed, then they should keep on hooting and see if they could disable the vehicle. If not, they should leave it alone and not mess with it. ....unless there were other references to "booting" in more authoritative clauses within the document. Typos have no place (or excuse) in legal documents.... particularly when they describe agreed action. Frank
