Exactly. While the Glock doesn't have a traditional safety, you still have to pull the trigger to get it to discharge. Had he not been fingering the trigger it would not have gone off. Of course his attorney is going with an accidental discharge to reduce the severity of the situation. It is a lot easier to get a slap on the wrist for an accident then to try and explain why you were playing with the trigger of a loaded gun in a crowded night club. One shows it wasn't your fault, the other shows your complete disregard for the safety of your fellow man. Hopefully the Ass. DA or Judge has an understanding of Glocks and will see through the accident claim.

But they're not getting him for accidental/negligent discharge, discharge within city limits, etc. They're getting him for carrying it without a license. I personally don't think an otherwise law-abiding citizen should even need a permit to carry, because that leaves it open for commie states (like Maryland) to deny people their right to self-defense based on crazy stipulations or arbitrary application of the rules. Allegedly it's possible to get a permit there, but you will greatly improve your chances of getting one if you have been victimized previously, which kind of defeats the purpose.

In Scott-land, he'd be penalized severely for a negligent discharge, but nothing else assuming he had no prior criminal record. Unfortunately for him, the liberal enclave of NYC and its RINO mayor don't see it that way.
